If a regulation giving specifications that are unattainable in real life then those needing to attain those specifications will use those specifications to attain conformity, however if the regulations do not specify that the specifications may not be exceeded outside of the test a specification then the regulation is nothing more than a nodding acquiescence to those who demand such regulations.
The car manufacturers program their ECU s to comply with those specifications and hope the vehicle fall off in performance will not be noticed as the regulation specifications area is passed through, VAG just went a touch further and made sure the car performance was not affected in that area when it was not being tested. I suspect that the cars will have a new ECU program and a bit of a flat spot in performance passes through test area.
Just hope the drivers are not in the middle of a Kamikaze overtake when it happens, it could be said VAG were looking after the drivers welfare in ensuring the cars performance wa s linear. Maybe therefore , if this is correct , then the vehicles will not be to the specification as descibed and purchased meaning a possible request to return the car to the dealer for a refund

Again who is going to buy a secondhand car from VW group that has this potential fault.?

Just been announced that all sales of VGA 1.6 and 2.0 EA189 Diesel engines have been suspended indefinately after a meeting between Australian Govt Officials and VGA.
Affects Volkswagen CC, Jetta, Passat, Tiguan, Caddy, Scoda Superb, Yeti MY15

Censored hitting the fan here now - Audi A4, A5 and Q5 have been added to the suspended list and Audi have come out and said that these vehicles have the emission cheating software. The ACCC has come out and said that current deliveries have been suspended and Audi is meeting with the ACCC to discuss their action. Heavy fines are being discussed. MY15

how long before other manufacturers own up to this ? my motor is Euro V compliant but I don't think its clear what class of cars are affected.

I have a mate who works for Skoda and he explained how the dodgy software works

When the ECU detects that the car is running at around 2500rpm (the rpm required for the emissions test to record the exhaust output), but without detecting that the car is in gear or wheels rotating, then the ECU knows it is being tested and adjusts all the sensor outputs to temporarily reduce the levels accordingly.

at least the government has said it wont increase road tax on affected cars, but how long before the price of diesel rockets a the pumps to try and force us out of diesel cars.

The government has known for years that diesel produces nasty stuff, but the CO2 is lower and this was there main focus, now it's nitrogen oxide that they are after. So after persuading everyone that diesel is the way to go and now loosing money because of the lower taxes, it's now a case of heavily tax the diesels for going into cities, force people to trade their diesel in for a petrol or a hybrid and that is then a hefty chunk of VAT to George Osborne. Why don't you just bend us over a barrel George and shaft us good and proper.

Diesel cars are scape goats, the majority of cars on the roads are diesel. Penalise the masses, a quick way to get money.

My 3.0 litre diesel will be staying. 21MY Defender 90 S 3.0 D200

A lot of the anti Diesel sentiment seems to stem from the UK being sued by the EU for failure to meet NOx emission targets. This combined with the proposed ultra low emissions zone in London could result in high NOx emitters facing penalties in certain parts of the country.

Emissions and efficiency testing is known to be flawed. There are plans to introduce real world emissions testing, but unsurprising the car industry is lobbying against it and nothing will appear until 2017 at the earliest apparently.

I have been looking at the Outlander PHEV, and whilst Mitsubishi Corp make a great deal of the 'official' 148 mpg figure, the troops on the ground seem somewhat embarassed by the claims, and will give you their view of real world figures (around 55mpg seems to be common).

There seems to be a need to remove politics from these tests, as well as develop a more joined up approach to alternative energy solutions. Electric cars are all well and good, but whilst the majority of it is produced from fossil fuels, vehicles like the Outlander PHEV are just moving the emissions to a different place. I can't believe any car for the foreseeable future is going to be carbon neutral over it's lifetime (say 10 years).

Anyway, the reason for posting was mainly to share this interesting article which gives some insight into the VW Corporate mentaility
