Arguement with a Bus

My FL2 decided to have an arguement with a bus this morning, bus decided to pull out on me but according to the driver it was my fault as they did indicate and I didnt stop even though they was pulling into my lane and as I stated she (yes female bus driver - case closed Whistle ) should have made sure it was safe to pull out first.

Damage to my FL2 thankfully is only the passenger wing mirror, the glass is fine but the housing is Censored, got to work and had to duct tape it back on, the mirror still moves electrically from inside but the powerfold no longer works (although I can hear the motor) and the temp gauge in the car reads blank (temp sensor is in the wing mirror).

National Express have a procedure where they may organise and payout for any damage without going through insurance, probably to keep their premiums down I dont know and I have rang the number the bus driver gave me and gave my account of the incident - they will come back to me with an answer 'soon'. If they refuse to pay I dont really want to go through my insurance as the excess we probably be more than the cost of a wing mirror - anyone know of one going spare or where the best place to buy is. Seen a couple on ebay for around £75 Big Cry

the fact that it was a bus may mean that it would need to go through the insurance companies due to third parties, etc ( public liability and all that stuff )

There was a programme on the goggle box recently that stated that large bus companies do not have insurance as such, they pay into a bond, which is held by a top law company which just fights the case so they don't usually pay out Sad

yeah my last company was like that - they had a lot of vehicles and so rather pay insurance premiums they had a certificate of insurance that stated that they would payout upto a maximum for third party claims.

In fact - I got hit by a bin lorry once... Letting a bus out that is indicating to do so is not Road traffic law but a Highway code recommendation.

I would pursue the bus company / driver for Driving without due care and attention or consideration for other road users, Sec 3 RTA 1988.

I have noticed that bus drivers never pull out when indicating when I am behind them driving a company vehicle! Very Happy

An Arriva bus did the same thing to me. It turned out that all buses built after a certain date have internal and external cctv cameras fitted and they were able to review the file and confirm that the driver was at fault.
They referred the matter to a loss adjuster and coughed up for the new door mirror. I got the impression that an Insurer was not involved.

GOOD NEWS!!!

National Express called to advise me that they have interviewed the driver and viewed the camera footage and take full liability for the incident - off to LR for an over the top quote and they will pay! Very Happy

Yes, in fact anyone can do this - there used to be a guy with a six wheel "Rolls" with a Merlin engine in it who couldn't get insurance so he just posted the bond - I think it was several hundred thousand at the time. London buses always used to do this too. The Royal Mail were slightly different - I think I read that they actually run their own in-house insurance company.
