1. It is indeed an assault.

2. The goods don't actually have to leave the store for theft to occur. The theft comes at the time of appropriation (dishonest) of property so it then just comes down to if the defendant intends to permanently deprive. Although if the police had apprehended him in the shop, it would far more likely result in an attempt theft as the defendant would have gone beyond merely preparatory as per the Criminal Attempts Act 1981. LL.B (Hons) - University of Derby

That shop is just round the corner to where I work. I understand that the 'slapper' was prosecuted recently. Mind you, if I'd have caught someone stealing my living I'd have..........well, perhaps not as prolonged as that but a swift kick up the arsenal when ejecting him from the store would have been in order I think. I wouldn't have wasted my time apprehending him and holding him for 45 minutes while the local Police (literally at the other end of the street) finished their tea break.

I think we need to stick within the law, no matter how appealing the owners response may seem, otherwise the boundaries get very blurred. He may have got away with a quick kick as an out of the ordinary reaction but he went too far. Plus, you never know what the other person is capable of or what weapons they may be carrying. The owner was lucky to avoid any retaliation, but who knows what the 'scrote' and his mates might do in the future?

my view is, he has slapped a thieving scroat and brought the brand of Cost Cutter under fire

He will most likely have a franchise and i would expect there to be clauses in to protect the brands identity which their lawyers will be having a good look at

He then steals the guys personal belongings himself by not giving him back his bag (and what ever is in there)

Saying things like this isn't like any other store makes me thing what dodgy dealing are going on behind the till

Wouldn't surprise me if he was just a bit simple, going by his reaction of wanting his bag back and standing there letting himself be slapped like that. Get the feeling he's probably a regular in there....

It seemed the slapper and his friend controlling the camera choose their victim.
Very disturbing, similar to the happy slapping vids from some time ago.
BTW, I never saw anything being stolen or retrieved?
