Unfortunately he seems to have only won by default. It would’ve made a better story if his arguments had been proven as correct by the judge and meant that people charged by these firms had some basis on which to challenge the tickets that are issued. Sad 32 years / 25 Vehicles

What about all these "Don't Drive Tired" campaings and signs by the government? I do know that operators of motorway service stations have to fulfil certain obligations to the public in order to obtain the leases, but I don't know where they will be stated. Everyone can spread it - Anyone can catch it. Stay home - the life you save can be your own!

The motorway services parking fees are just money for nothing...
I used to drive HGV a few years back and occasionally (when I had no choice due to driving hours) stopped at night in motorway services.
the tarmac was deeply rutted, potholed, cracked and may as well just been a rough gravel area.... and because the HGV area was always so far away from the 24 hour toilets the whole area stank!
basically they were charging £10 for an overnight park up (anything over 2 hours) but paying nothing out for it.

hopefully this case does set a precedent, but I for one don't have the funds or time to risk contesting if I was caught out.

yeh I tried to avoid it and preferred parking up in the peak district, the motorway services always used to creep me out and ive slept in some pretty grim places in the past Laughing

haha... ive slept in occupied cow sheds/field, holes in the ground, snow holes, on top of trucks(never under!), in between huge aircon units and woken up to all manner of wildlife crawling over me.

give me any of those over a motorway truck stop anytime !!

Having been issued a parking charge by a PPC I spent quite some time researching the situation.

There is much information on the MoneySavingExperts site, as well as a few people who dedicate their time to assisting with defences. There are usually some straightforward arguments to defend these claims if you're willing to put in the leg work. Often the ticket itself is flawed, or they have failed to follow their own ATA code of conduct.

Furthermore many of the solicitors that the PPC use are incompetent and ill-prepared. Have a look at some of the examples on the Parking Prankster site.

Will this case set a precedent. My understanding is that it will not, not at CC level. However it's another case that can be referenced in a defence.

Much of the problem with PPCs is the introduction of the 'POFA' law in 2012 that allowed them to pursue vehicle's keeper. That and the failure of the DVLA to adequately enforce the data access requests that PPCs can make to obtain keeper details. I believe the government is planning to crack down on this.

If you get a private parking charge (not a fine), please don't pay it. Defend it.

"exceeded the free period by only 20 minutes". That's the key word - Exceeded.
Mr Bowen insists there was no signage with parking information where he parked.
Then contradicts this . He said signs making reference to 24 hour charging were in tiny print in another part of the car park. So there WAS signage . Just not exactly in front of the bay he chose to park in.
That's the technicalities that win these parking firms their case. Ignorance is no excuse.
I believe Mr Bowen (QC) was fully aware of the signs and charges but unfortunately didn't wake up in time. Then used his "influence" as a QC to find in his favour and thus avoid paying a fine . He was not " challenging on behalf of the general public."

Don't get me wrong - I think these car park firms are a scourge and I'm glad they lost. However, I do believe that had I used the excuses that Mr Bowen had used then it would have been thrown out and I'd be paying the price.

Elderly couple I know got done for this when the took a nap and overstayed, the fine \ letter was backed up by Wright Hassall Solicitors, which speaks volumes about the people involved. Boycott the Motorway Services....

Got stuck in a carpark a couple of years ago behind a queue of cars. I got out went to the front & forced up the boom gate by hand, not that difficult, first bit needs a bit of a tug on the boom, you have to hold the boom up as they want to keep going down as you can feel the motor, & indicated to everyone to drive out,..... so I could get out!

If the carpark can't manage the exit that's their problem!

It is the same with sliding doors in shops if they don't open, simply force them open, they do move as it is part of fire safety that doors can be slid open. Procrastination, mankind's greatest labour saving device!
