Just spoken to Citizens Advice Scotland. Basically the general rule is the refund is made in the same way as the purchase was. This is tricky as the car was basically swapped. There isn't a rule to say they must give me cash, or the old car back, but I am allowed to say I don't want the car if they still have it, because I don't know what has been done to it since they took it and we also traded it because we didn't want it.

I'm not mentioning it to them unless they do though. Learned to drive in 2011.

IMO what would suit both parties is for the dealer to give you cash/cheque for the full purchase price of the Ka on the sales invoice as you have already been given the cash for the difference. You will then be fully back in pocket and the dealer would have the Audi and the Ka on his forecourt to recoup his costs. Win/Win for all concerned.
Documentation will already be in motion on the Audi from both of you, and to give you the Audi back would mean you would have to repay him the difference you got given in cash on the Ka deal after he has refunded the price of the Ka.... basically a paper and logistical minefield.

However dealers don't like being out of pocket at all, never mind breaking even !!

I once bought a Discovery TD5 auto from a small dealer, gearbox was faulty from the start, he had several attempts to fix it, failed. So I called in the finance company and got a new Ashcroft recon box fitted at a garage of my choice, all at their expense.
1 week later the gearbox bent its flex plate(the original fault) and the hydraulic pipes came off spilling fluid all over my drive. Oddly enough the inspection plate was missing that was secured with 3 screws.
Only possible conclusion was that the dealer had sent a couple of lads round in the night, removed the inspection cover, bent the plates again and disconnected several pipe clips, but obviously this couldn't be proved.... Hell hath no fury like a car dealer out of pocket !!

S.20 (16)If the consumer paid money under the contract, the trader must give the refund using the same means of payment as the consumer used, unless the consumer expressly agrees otherwise.

Still no feckin' V5C.

Out of frustration I emailed the DVLA complaints address about how they don't have a system for such an issue even when the law was changed to make the whole 30 day thing easier. And of course, automated reply stating a 10 day wait for a reply. I should have known. Learned to drive in 2011.

Honestly, I could cry.

Phoned the DVLA again on Tuesday to ask where on earth the document was. The guy said he couldn't speak to me as I wasn't the name on the application, despite seeing my email address and phone number on the application and all the notes of previous phone calls.

My wife, who was on a boat just off Orkney at the time, called and asked what the hell was going on. They updated the notes to say I was allowed to deal with this and if the doc wasn't received by post by today to call them back.

No document so I called. They have now said that the address issue was only spotted when my wife called on Tuesday and so a case has been opened so it will be another 7 working days at a minimum. I've complained again as we found the address fault on about the 5th or 6th of May and they promised it was dealt with and the application would progress as normal.

Furious at their incompetence. Learned to drive in 2011.

When I had to have submissions from two senior consultants reviewed by the DVLA Medical Panel regarding whether or not my license should stay on 10 year renewal, or go onto 3 or 1 year , it took them an oh so reasonable 14 weeks Rolling with laughter The funny thing was that after 12 weeks of not driving under the DVLA medical condition notification scheme , I was free to drive until they arrived at their decision two weeks later. A mate of mine who had to notify a much more serious condition was faffing about for 20 weeks before they made their decisions. 2009 GS Auto Zermatt Silver - Sold June 21 after 10 years of ownership
